Multinational Enterprises and the Law
Autor Peter Muchlinskien Limba Engleză Paperback – 16 dec 1999
Split into three major sections the book deals with:
- Part I - the conceptual background to MNE regulation.
- Part II - a complete examination of the limits of national and regional jurisdiction in regulating MNEs, restrictions on entry and establishment, investment promotion, the impact of the WTO post-entry controls in the fields of tax, company law, antitrust and labour law.
- Part III - the contribution of international law and organizations to the regulation of MNEs, including renegotiations and expropriation, ICSID, MIGA and bilateral investment treaties.
The author has skilfully identified the contributions that economics, politics and sociology can add to a full understanding of the legal environment in which the MNE operates. There can be no doubt that the breadth and depth of the coverage in this book will make it the definitive reference for students, researchers and practitioners in international law, business law, development studies, international politics and international business.

Recenzii
Muchlinski's comprehensive monograph is immensely rich and thus most valuable for everyone who is interested in globalization and law. Each edition opens up new directions and perspectives we ought to consider. It provides legal scholars with a precious treasure-hunt map of the legal obstacles we ought to overcome if we aspire to challenge and reform the existing legal order.
The book is eloquently written and is easy to follow and understand. It clearly explains complex topics and masterfully links them together in a coherent narrative. The brevity of the analysis of certain areas of law and regulation, however, does not undermine the validity of conclusions made throughout Multinational Enterprises and the Law, its contribution to the academic debate and its use as an excellent source for practitioners.
Peter Muchlinski's formidable volume, Multinational Enterprises and the Law, came out in its third edition in 2021, and should be on the reading list of all scholars working in the area - or areas, rather, as the book canvasses a remarkable number of themes relevant to multinational enterprises.
